Collectively, all of the above people or animals entering this Agreement will be referred to as the "Parties." 

In consideration of my engagement as a model, and for the other good and valuable consideration herein acknowledged as received, I hereby grant to Shelley Paulson, Shelley Paulson Photography, of Buffalo Minnesota USA ("Photographer"), his/her heirs, legal representatives, and assigns, those for whom Photographer is acting, and those acting with his/her authority, and permission, the irrevocable and unrestricted, right and permission to take, copyright in his/her own name or otherwise, and use, reuse, publish and republish photographic portraits or pictures of me or in which I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own or fictitious name, or reproductions thereof in color or otherwise, made through any medium at his/her studios or elsewhere, and any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoever. I also consent to the use of any published matter in conjunction therewith.

 
I hereby waive any right that I may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied.

I hereby release, discharge, and agree to save harmless Photographer, his/her heirs, legal representatives, and assigns, and all persons acting under his/her permission or authority or those for whom he/she is acting, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.

In consideration of the herein listed animal’s engagement as a model, and for other good and valuable consideration herein acknowledged as received, I agree to allow the animal to model for the purpose of creating photographs for advertising and marketing and accept the terms for which the photography is offered. I grant the rights in this agreement to Shelley Paulson Photography (ʻPhotographerʼ), his/her heirs, legal representatives, and assigns, those for whom Photographer is acting, and those acting with his/her authority and permission. Under this agreement, Photographer has the irrevocable, perpetual and unrestricted right and permission to license any of the photographs he/she creates to any company to use in any media in any geographical area for any length of time, with no restrictions on their use. I agree to waive the right to approve any and all photographs with the animal’s likeness prior to their use. Photographer owns all copyrights to his/her photographs from the time they are created, in perpetuity.

I represent and warrant that I am the legal owner or guardian of the herein listed animal, and have every right to contract in my own name and grant the rights herein. I agree that I have read this Model/Property Release, prior to its execution, and agree with its terms. 

Copyright Ownership

Photographer owns the copyright in any and all images he/she takes pursuant to federal copyright law (Title 17, Chapter 2, §201-02, of the United States Code.) Any and all photographs produced in connection with, or in the process of fulfilling this agreement, are expressly and solely owned by Photographer to use in the reasonable course of business.

Assumption of Risk

Model and related parties/ participants expressly assume the risk of participating in Photographer’s equine photography sessions as described herein. Model understands that some or all parts of any photography session may take place outside, and Model and any related parties assume the risk of conducting themselves properly given the circumstances.

 

Equine Liability Waiver

UNDER MINNESOTA LAW [Minn. Stat. § 336.1-101(1994)], AN EQUINE ACTIVITY SPONSOR OR PROFESSIONAL SHALL NOT BE LIABLE FOR ANY INJURY TO, OR THE DEATH OF, A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISK OF EQUINE ACTIVITIES.

Farm Animal Waiver

Horses are farm animals and as such, vary in behavior, temperament, personality and training. Any farm animal professional who works around or handles farm animals, such as Photographer working around or handling Equines, is NOT liable for the inherent risks associated with equine activities.

 

Inherent Risk of Equine Activities

Model and Model’s Group understands equine-related activities are inherently dangerous and involve risks that may cause serious injury and in some cases death. Model and Model’s Group acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes ALL risks associated with participating in such activities, including any acts of ordinary negligence. The inherent risks include, but are not limited to: the propensity of equine to behave in ways such as, running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equines reaction to such things may occur without warning or any apparent cause; the limited availability of emergency medical care; and the potential of Model or member of Model’s Group to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such Model's ability.

  

SAFETY RESPONSIBILITIES

The Model is responsible for his or her own safety and the safety of any Group members he or she brings with him or her while engaging in any and all equine activities during the Session. Furthermore, Photographer (and its employees, agents and independent contractors) is/are NOT liable for any injury of horse or handler during the session time or while Services are rendered.

 

Model HAS READ, UNDERSTOOD AND RELEASES PHOTOGRAPHER FROM ALL RELATED CLAIMS OF EQUINE ACTIVITY AND ORDINARY NEGLIGENCE IN THE COURSE OF PHOTOGRAPHER’S SERVICES. Acknowledgement signified by the signing of this document below.
