Dear FoodLink Partner Agency,
Thank you for your continued partnership with FoodLink! We value your agency as an extension of our work to alleviate hunger and build a healthy community. We are always looking for ways to strengthen our relationship with you and continue to provide quality food and services to our communities, so you will find some important additions to our Agency Agreement and Attachments. Please sign and submit the attached Partner Agency Agreement Packet to continue our important work in 2025. Signed and completed Agreement packets must be received by January 31st, 2025. Failure to provide the Agreement and ALL supporting documentation will result in a suspension of February deliveries.

For the period of January 1, 2025 through December 31, 2025. FoodLink hereby designates Agency, subject to the provisions of this Agreement, as an authorized organization to receive USDA commodities food and other products from FoodLink. Agency agrees to accept and use all products from FoodLink exclusively for Agency's hunger relief/nutrition program for needy people.
This Agreement supersedes any previous agreement written or verbal.
Terms of the Partner Distribution Agency Agreement: The Agency agrees to all of the following terms and conditions of this Agreement that comply with The Emergency Food Assistance Program (TEFAP) under California Department of Social Services (CDSS If any of these terms and conditions are violated, FoodLink has the right, without further investigation, to stop distributing product to the Agency and/or follow processes outlined in the Notice of Non-Compliance and Corrective Action document until terms and conditions are met.
This agreement is made between FoodLink for Tulare County, Inc. ("FoodLInk") and 1Agency Name.
The Agency agrees at all times during the term of the Agreement to the following:
Section One:
1. Per Policy Notice 17-05 of the California Department of Social Services, Agency is required to annually meet the IRS eligibility requirements for receipt, transfer and use of donated food under section 170(e) (3) of the IRS code as stated below:
a. Agency is incorporated as a 501 (c) 3 nonprofit corporation or is considered a "church" as defined by the IRS.
b. Agency is required to serve ill, needy and/or infants (minors 0-18 years old c. Agency is required to distribute the donated USDA commodities/products obtained from FoodLink free of charge (monetary, volunteer hours, services or otherwise
d. Agency is required to distribute products to recipients who qualify as ill, needy and/or minor children. The Agency also agrees that it will not distribute donated products to people who do not qualify to receive the products as defined by the IRS Tax Code Section 170 (e) 3.
e. Agency will not barter, sell, or use donated products in exchange for money, other property or services, including using donated products for the purpose of fundraising, programs or events.
2. Agency is required to carry liability insurance of at least $500,000 with FoodLink named as an additional insured.
3. Agency is required to serve the needy in accordance with United States Department of Agriculture (USDA) rules which prohibit discrimination on the basis of race, color, national origin, gender, religion, age, disability, political beliefs, sexual orientation, and marital or family status.
1Agency Name hereby affirms that the original donor, FoodLinkfor Tulare County, Inc. is released by the Agency from any liabilities resulting from donated goods andheld harmless from any claims or obligations in regard to the Agency, the people it serves, or theproducts/food received by FoodLink. FoodLink offers no express warranties in relation to the gift of goods.
Section Four:
PARTNER AGENCY ACCEPTANCE and receipt of Agreement and Attachments.

Agency representatives will also ensure that any employees or volunteers of this agency who interact with this program in anyway will be fully informed and trained to comply with the rules and regulations contained within thisAgreement and treat recipients with dignity and respect.
Agency representatives understand that the Agency must implement the rules and regulations as stated in the FoodLink Partner Distribution Agency Agreement immediately upon entering into this agreement.
Section 1: Warehouse

PROCEDURES FOR ORDERING AND FOOD PICK UP:
Partner Agencies may pick up food one day per week. Appointments and orders must be made
Only designated agency representatives may pick up food. If your representatives have changed, please let us know. Be sure to order ONLY what you need. Orders should not be changed after order has been assembled, except under special circumstances. You are responsible for loading your own vehicle. Partner Agencies should bring enough able-bodied volunteers to help load. Any accidents or mishaps in the parking lot are the responsibility of the parties involved and not that of FoodLink for Tulare County, Inc. FoodLink may ask you to take extra food items when there is a surplus. Please accommodate whenever possible.
SAFETY AND SANITATION REGULATIONS:
Partner Agency representative must remain in designated waiting area until helped. No one, except FoodLink staff and volunteers, are allowed outside the reception area of the warehouse. Only trained FoodLink staff and volunteers may use, drive, or ride in FoodLink trucks, forklifts, pallet jacks, or other equipment. All vehicles used to transport food must be very clean and free of toxins materials and clutter. Food must be covered during transport; waterproof tarps and ropes are required during wet weather. Insulated blankets must be used on cold and frozen. You will not be allowed to load
When you arrive at FoodLink, do not pull into the warehouse door until told to do so. All Partner Agencies must be proper handling facilities for refrigerated and frozen foods.

All Partner Agency staff and volunteers must read, understand, and agree to follow these guidelines.
Section 2: Safety & Sanitation
All Food Distribution Agencies, including food pantries, group homes and shelters, congregate feeding agencies (Soup Kitchens) and other food distribution sites or agencies, such as USDA Distribution Sites, must follow safe and sanitary food handling procedures. Please ensure that your staff and volunteers are knowledgeable about safe food handling procedures and have access to this information.
Remember, if in doubt, throw it out!
The partner Agency, Staff, and Volunteers have read, understand, and agree to follow the safe handling sanitation rules above, and as found in the Guide to Safe Food Handling and Sanitary Standards.

Note: FoodLink does not intend to audit or monitor Agency's finances. Agency must show sources of funds to meet operating expenses. Please remember that soliciting donations from clients is not an acceptable method of fundraising.
