    • For the purposes of this Agreement, the terms “Delegate” and “Titleholder” shall have the same meaning and may be used interchangeably.


      1. Publicity and Promotion Release.  By virtue of participation in the America’s Ideal Miss Organization, Delegate agrees to allow America’s Ideal Miss, LLC the right to use her name, likeness, voice, and/or biographical information for purposes of publicity and promotion now and in the future. Delegate understands that her name, likeness, voice, and/or biographical information may be used on the internet, in print advertising, press releases and merchandise related to America’s Ideal Miss (e.g., t-shirts, tote bags, hats, other apparel, and other promotional materials). Delegate agrees to release America’s Ideal Miss, LLC from liability for any injury resulting from publicity and promotion. Delegate agrees to waive all compensation for use of her name, likeness, voice, and /or biographical information for purposes of publicity and promotion.
      2. Disqualification / Title Relinquishment.  If Delegate is disqualified or relinquishes any title awarded to her, for any reason, she must return all prizes in full and in the condition in which they were received. In such circumstances, the title and any associated prizes may be reassigned to another individual at the sole discretion of the Organization.
      3. Limitation of Liability.
      a. America’s Ideal Miss, LLC is not liable for any direct, indirect, incidental, consequential, or special damages to Delegate arising out of or in connection with any State Director or Affiliate leading to the America’s Ideal Miss National Pageant. Delegate releases and holds harmless America’s Ideal Miss, LLC from any claims of liability including but not limited to warranty, tort, negligence, contract, even if America’s Ideal Miss, LLC, its owners, officers, employees, or agents were informed of the possibility of such damage, such damages are foreseeable and even if these remedies fail their essential purpose.  Delegate agrees to look solely to the State Director or Affiliate with respect to all matters relating to her application, rules, regulations, policies, preparation, rehearsal, performance and selection process, and all other matters relating to the State or Region Affiliation.
      b. America’s Ideal Miss, LLC, its officers, employees, and pageant personnel are not responsible for accidents, injury or theft incurred at the time of any America’s Ideal Miss activities or during travel to and from the pageant or any related competition, events, or appearances.
      c. America’s Ideal Miss, LLC is not responsible for negligence or fraud on the part of State Director, Affiliate or Producers of any Preliminary Pageant, sponsors, judges, or contract vendors (e.g., photographer, videographer, etc.) who may provide products or services to Delegates. 
      d. America’s Ideal Miss, LLC is not responsible for negligence or fraud on the part of any travel services, hotel or lodging used in connection with the America’s Ideal Miss National Pageant or Preliminary Pageant.
      e. America’s Ideal Miss, LLC is not responsible for arranging travel or intervening in or resolving disputes surrounding travel in the United States or internationally for any activities, events, or obligations associated with the Organization.
      f.  America’s Ideal Miss, LLC is not responsible for loss, theft, or damage caused to any prizes, gifts, and awards bestowed upon Delegate after these items become the property of Delegate. Delegate agrees to incur replacement and/or repair costs to lost, stolen, or damaged items including but not limited to: crown, sash, delegate shirt, etc.

      By submitting the registration form and fees to America’s Ideal Miss {state}, which leads to the America’s Ideal Miss National Pageant, Delegate agrees to abide by all rules, regulations and the conduct code established by America’s Ideal Miss and as more specifically set forth on Exhibit A to this Statement of Understanding. Delegate attests that all information submitted to America’s Ideal Miss is true and accurate. Falsification of information and failure to comply with the policies of America’s Ideal Miss may result in immediate disqualification and forfeiture of prizes received without benefit of refund in full or in part at the sole discretion of America’s Ideal Miss, LLC.

      Exhibit A

      Rules, Regulations and Conduct Codes
      Following are the Official Rules, Regulations and Conduct Code (collectively, the “Rules”). For purposes of this Exhibit A, “America's Ideal Miss, LLC” and "America's Ideal Miss {state}" includes the entire pageant enterprise, including both state and regional titles. To be eligible to accept a state or regional title with America’s Ideal Miss, Delegates and parents/guardians of minor Delegates must read, agree to and adhere to the following Rules.


      Eligibility
      1. Delegates must be a natural born female, presenting as and competing as a female.
      2. Delegates must be ages 4 to 27 years old as of July 1, {fiscalyear}. A copy of each Delegate's birth certificate must be provided to verify age.
      3. Delegates must have a permanent and primary residence or be a full-time student in the state or region represented and a citizen of the United States.
      4. Delegates must not be married or ever have been married.
      5. Delegates must not be pregnant or have given birth.
      6. Delegates must not be legally responsible for the custody of another person.
      7. Delegates must not be current International or National titleholders with any other pageant system as of the date of the {fiscalyear} America’s Ideal Miss National Pageant.
      8. Delegates must be of good moral character.
      9. Delegates must never have posed nude in print or any other medium.
      10. Delegates must have no criminal record or convictions of any kind.


      Other Terms
      1. It is unlawful for underage Delegates to smoke, vape or use alcohol. America's Ideal Miss Organization requires Delegates of all ages to abide by the law. Delegates old enough to legally smoke, vape or drink alcohol must nevertheless refrain from doing so while at the pageant or while representing America's Ideal Miss Organization in any capacity.
      2. All Delegates, pageant employees and volunteers must be respectful of America's Ideal Miss Organization and all associated individuals in all interactions. In addition, all Delegates, pageant employees and volunteers are expected to be respectful of all other pageant systems, and their delegates and titleholders.
      3. Delegates must conduct themselves as role models and be mindful that their social media posts and those posted by others that include them reflect on them, and by extension, on America's Ideal Miss Organization. Appropriate social media posting choices are expected of all Delegates. All material on social media pages must be in good taste.
      4. Delegates must have paid in full prior to receiving their title, crown, sash, delegate shirt, etc.
      5. Delegates must comply with all deadline dates. If Delegates have not submitted or paid by the deadline, late fees will be assessed.
      6. America's Ideal Miss Organization may change the date and/or location of any pageant events and activities as deemed necessary in its sole discretion.
      7. America's Ideal Miss Organization is not responsible for prizes forfeited by sponsors.
      8. America's Ideal Miss Organization has the right to refuse entry to any pageant events and activities as deemed necessary to any Delegate or observer at its discretion.
      9. Delegates understand that withdrawal from the America's Ideal Miss State or Regional Delegation for any reason will not result in a refund of any fees or a credit toward the {nextyear} National Pageant or any future event. Delegates understand that all fees paid to America’s Ideal Miss, LLC and to America's Ideal Miss {state} are non-refundable and non-transferable under any circumstances. Non-refundable fees include, but are not limited to, registration fees, entry fees, ad fees, pageant admission tickets, optional competition fees, donation fees and any other fees paid.
      10. Delegates will be required to sign a State or Regional Titleholder Contract and Code of Conduct.
      11. A Delegate selected for a state or regional title agrees to attend the crowning ceremony or state and regional pageant the following year to crown their successor. Delegates must abide by all Rules or forfeit the title. If a Delegate relinquishes or forfeits her title, for any reason, all prizes, crown and sash must be returned in full at the Delegate’s expense, and in the condition received, within ten (10) days of any such forfeiture.
      12. Sportsman-like behavior is expected of all Delegates and their supporters. Any displays of disrespect at pageant events or activities may be cause for disqualification and revocation of the Delegate’s title. In any event, there will be no refunds.
      13. Delegates, titleholders, and their parents/legal guardians give permission to America’s Ideal Miss, LLC and America's Ideal Miss {state} to use of any and all photographs, videos, audio recordings, speeches, testimonials and any other copyright material for promotional and publicity purposes in all, but not limited to, mass broadcast (such as streaming video, films, radio, recorded music, television), print (such as books, magazines, newspaper, pamphlets), and digital media (internet and mobile mass), without compensation, in perpetuity.
      14. Delegates and their supporters will permit the use of their images in all live and recorded streamed and televised content, video and photography mediums and platforms taken during any part of pageant events and activities.
      15. By signing and acknowledging these Rules, I agree that I am obligated to compete at the {fiscalyear} America’s Ideal Miss, LLC National Pageant. If I cannot uphold this agreement, I will notify the America’s Ideal Miss, LLC office immediately. I acknowledge that all fees and purchases are non-refundable.

      As a State or Regional America's Ideal Miss titleholder, I hereby agree to all Rules outlined in this agreement.

    • Congratulations! We are so excited to welcome you to the America’s Ideal Miss Royalty sisterhood! Being a State/Regional Titleholder is a rewarding and unique opportunity filled with new experiences and responsibilities. 


      As an America’s Ideal Miss State/Regional Titleholder (hereafter referred to as “Titleholder”), you and your parent (if you are under legal age of consent) understand and agree to this Titleholder Contract and Code of Conduct as a prerequisite to your state/regional reign and a requirement in order to compete in the America’s Ideal Miss National Pageant (hereafter referred to as “National Pageant”). Failure to comply with the provisions of this Contract does not in any way release the Titleholder from responsibility to abide by the Titleholder Contract & Code of Conduct stated here and may result in immediate disqualification, relinquishment of your title, forfeiture of prizes and awards received, including but not limited to the America’s Ideal Miss sash and crown, and render you ineligible from participation in the National Pageant, determined solely and exclusively by America’s Ideal Miss, LLC along with the respective State Director. 


      This Contract is in addition to the Statement of Understanding, Agreement & Rules, and Exhibit A statement that you have signed and that you will sign when registering for the National Pageant, all of which still apply. 


      CONTRACT AGREEMENT 

      1. Titleholders are REQUIRED to compete in the National Pageant to represent their state or regional title. If Titleholder does not compete in the National Pageant, it may result in immediate disqualification, relinquishment of your title, and forfeiture of prizes and awards received, including but not limited to the America’s Ideal Miss sash and crown. 

      2. The reign of the Titleholder will commence immediately after crowning and will end immediately following the crowning of your successor unless the Titleholder is disqualified or relinquishes the title. 

      3. Titleholder agrees to make a minimum of 12 appearances throughout the year’s reign. Appearances may include but are not limited to community service projects, parades, radio, television and newspaper interviews, other America’s Ideal Miss State Pageants, and public appearances at events. Titleholder agrees to provide America’s Ideal Miss with photos of appearances for the America’s Ideal Miss websites, social media platforms and promotions. 

      4. Titleholder may have a modeling, commercial tie-up, personal management or agency contract. Those contracts do NOT authorize or permit the use of the America’s Ideal Miss trademark or any other registered trade name, trademark, or logo of America’s Ideal Miss or any title designation or reference with respect to the pageant in any manner. 

      5. Titleholder agrees to attend the next year’s crowning ceremony or state pageant to crown her successor and agrees to fully participate in all relevant pageant events unless the Titleholder is disqualified or relinquishes the title. If you competed in a state pageant, in order to receive the remainder of the state cash scholarship and any remaining prizes won, Titleholder must complete her entire reign, including but not limited to attending next year’s state pageant. 

      6. The passwords will be given to you for the America’s Ideal Miss Titleholder social media pages. If, for any reason, the passwords are changed during the reign, the Titleholder agrees to immediately notify the state director of the new password(s) in writing. 

      7. Titleholder will be required to do sponsorship posts on her titleholder social media pages as instructed by the State or National Director. 


      8. Titleholder is strictly prohibited from printing, reproducing, copying, altering, manipulating, modifying, or using in any form the America’s Ideal Miss national or state logos, registered trade names, trademarks, copyrights, or signage for any purpose without the express prior written consent of the National Office.


      9. Titleholder agrees to sign the Titleholder Contract & Code of Conduct statement indicating agreement to abide by the terms specified here. Failure to sign the Titleholder Contract & Code of Conduct statement does not in any way release the Titleholder from responsibility to abide by the Titleholder Contract & Code of Conduct stated here and may result in immediate disqualification, relinquishment of your title, forfeiture of prizes and awards received, including but not limited to the America’s Ideal Miss sash and crown, and render you ineligible from participation in the National Pageant. 


      CODE OF CONDUCT 

      1. Titleholder will embrace a meaningful commitment to a charitable platform that resonates with you; be a role model by positively fulfilling the duties of your title and will uphold and promote America’s Ideal Miss and its values. 

      2. Social Media posts reflect on you, your family, your title, and the America’s Ideal Miss pageant system. Posts should be positive and respectable. Avoid questionable photos, videos, phrases, and sentiments. Distasteful content includes but is not limited to, revealing clothing, displays of affection with boys or girls, references to the use of smoking, alcohol and drugs, inappropriate music, and disparaging comments about others. 

      3. Titleholder should avoid making official statements regarding politics while representing America’s Ideal Miss on any level. 

      4. Titleholder agrees to abide by the terms specified in Statement of Understanding, Agreement & Rules, and Exhibit A statement (hereafter referred to as the “Rules”). Titleholder affirms that she is and will continue to be a person of good moral character; that she has not committed and will not commit any act inconsistent with the highest standards of public morals and conventions or that will reflect unfavorably on the pageant, its representatives, sponsors and/or licensees, during any state or national pageant, or during her reign as a state/regional/appointed or national Titleholder. 

      5. Titleholder will not slander or libel other contestants, judges, America’s Ideal Miss pageant, staff, or anyone else involved with or connected to America’s Ideal Miss. Defamatory oral and written remarks against America’s Ideal Miss LLC., America’s Ideal Miss State or National Pageant, and other pageant systems while associated with America’s Ideal Miss will result in disciplinary actions up to and including immediate disqualification, relinquishment of your title, forfeiture of all prizes and awards received, including but not limited to the America’s Ideal sash and crown, render you ineligible from participation in the National Pageant, and legal charges. 

      6. Good sportsmanship is expected at all times. Disruptive behavior before, during, or after the pageant will not be tolerated and may result in immediate disqualification, removal from the premises, relinquishment of your title, forfeiture of all prizes and awards received, including but not limited to the America’s Ideal Miss sash and crown, and legal charges. 

      7. All issues related to the Titleholder Contract, Code of Conduct, Statement of Understanding Agreement & Rules, and Exhibit A statement and consequences for violation thereof shall be determined solely and exclusively by America’s Ideal Miss, LLC along with the respective State Director. Titleholder agrees to accept such determinations made by America’s Ideal Miss, LLC both as to herself and others. 


      APPEARANCES 

      1. Anytime the Titleholder is wearing any America’s Ideal Miss attire, including but not limited to the sash and crown (even if you are planning or have coordinated the event yourself), you are representing America’s Ideal Miss, LLC. 

      2. When representing America’s Ideal Miss as a Titleholder, always dress the part of a Queen; use the “dress for success” rule with age-appropriate hair and makeup. Do not wear your crown at another pageant system’s event – proper etiquette is sash only. Do not chew gum while wearing your sash and crown. 

      3. Appearance outfits should be age appropriate. No short shorts, no short skirts, no faded and torn blue jeans when representing your title (unless previously approved). You must wear shoes at all times when wearing any America’s Ideal Miss attire during every event. 

      4. All Titleholders are expected to adhere to a no drinking, no smoking (including e-cigarettes), and no foul language policy at any America’s Ideal Miss sponsored event and when wearing any America’s Ideal Miss attire, including but not limited to your sash and crown. 

      5. Titleholder may not add pins, magnets, embroidered names, or any other items to her sash. When eating out in public please remove your sash during meals in order to keep your sash clean. 

      6. Titleholders should always be polite and respectful to adults, including their parents, when making appearances. Any issues should be resolved in private.


      COMPETING IN OTHER PAGEANTS 

      1. America’s Ideal Miss supports the pageant industry and understands its Titleholders may have a desire to compete in other pageants. Titleholder must submit a written request by email to compete in other pageant systems to the State Director BEFORE signing up for any pageant. The State Director will consult with America’s Ideal Miss National Director and will respond to said request within five (5) business days by email. If the Titleholder does NOT follow the outlined protocol and/or does not receive permission, it may result in immediate disqualification, relinquishment of your title, and forfeiture of prizes and awards received, including but not limited to the America’s Ideal Miss sash and crown. Oral permissions or agreements are not valid. 

      2. America’s Ideal Miss will not grant permission to compete in any pageant that is in direct conflict or considered to be a conflict of interest with America's Ideal Miss or any important dates associated with the America’s Ideal Miss pageant system. Permission will not be granted for participation in pageants that, if you were to win, you would be required to relinquish your America's Ideal Miss state/regional/appointed title before competing in the required National Pageant. 

      3. Upon completion of the National Pageant, any State/Regional Titleholder is free to participate in other pageants without obtaining written permission. However, State Titleholders who have competed and won their title must complete their reign and return to the State Pageant to crown their successor in order to be eligible for the state cash scholarship. Failure to complete the remainder of the reign will result in forfeiture of the remaining state cash scholarship and any prizes won, with no exceptions, as the Titleholder will then be considered to be representing another pageant system. In such cases, the Titleholder will still be invited to attend the State Pageant to crown her successor.


      ATTENDING PAGEANTS

      1. While attending any pageant system event, whether as a contestant or not, any unsportsmanlike conduct is prohibited.

      2. Please do not talk about other contestants, their parents, siblings, friends, or family members in a negative manner. Nor should there be any negative comments about America’s Ideal Miss pageant system and other pageant systems. Basic pageant and moral etiquette are required. 

       


      ACKNOWLEDGMENT AND AGREEMENT

      I understand that if I am unwilling or unable to fulfill my obligations under this Agreement for any reason, the State/Regional Title, and all prizes and awards received, including but not limited to the America’s Ideal Miss sash and crown, will be forfeited. In such circumstances, the title and any associated prizes may be reassigned to another individual at the sole discretion of the Organization. Titleholder agrees to accept such determinations made by America’s Ideal Miss, LLC. 


      I have read and I agree to the terms of this America’s Ideal Miss State/Regional Titleholder Contract and Code of Conduct. By signing and acknowledging these terms, I agree I am obligated to compete at the next year’s America’s Ideal Miss National Pageant.
