PROGRAM COST
Program cost includes all transport once in program, experienced facilitators, program delivery, all activity and safety equipment, food and accommodation if stated in the program description, and public liability insurance during activities. Program cost does not include travel to and from start and finish location.
PAYMENT
The Participant shall provide APA with full payment upon signing of this Agreement.
CANCELLATION
Standard Cancellation Policy
APA reserves the right to cancel applications that are not fully completed in a timely manner.
APA reserves the right to cancel any programs offered at any time due to inadequate enrolment that makes the program economically unfeasible to operate or because of good faith concerns with respect to safety, health or welfare of the participants. If a program is cancelled by APA more than 30 calendar days prior to program commencement, APA will refund all payments made by the applicant.
In the event of an act of war, terrorism, natural disaster, political instability, S.A.R.S or other force majeure that significantly impacts the ability to travel safely in the location of a proposed program, APA will refund up to 95% of total program course fee.
Upon payment of the program course fee, 25% of payment is a non-refundable deposit. Cancellation by participants more than 60 calendar days of program commencement results in a refund of 75% of the program price. Cancellation by participants between 8 to 60 calendar days of program commencement results in a refund of 50% of the program course fee. APA will not make any refund of program price for cancellations made less than 8 calendar days of program commencement.
APA has a zero-tolerance policy for any inappropriate behaviour that endangers the health, safety and wellbeing of our participants and staff. Unacceptable conduct consists of, but is not limited to:
-Possessing Alcohol, Nicotine and other contraband and illegal substances.
-Obscene, vulgar, pornographic and/or violent content.
-Verbal or physical abuse, bullying or discrimination.
-Refusal to cooperate with our staff, causing disruption or leaving site without permission.
-Stealing, damaging or destruction to property.
APA reserves the right to terminate the participant's participation in our program should one of the aforementioned situations occur. APA will not be held liable for any costs associated with a participant's inappropriate behaviour, including transportation costs for leaving the program and/or refunds for any remaining program days.
WEATHER
Whilst APA will endeavour to run a program as described on the program summary, if weather conditions are deemed unsuitable by APA during the program, APA reserves the right to modify program duration, activities and/or locations for the safety of both participants and staff without refund of any program fees.
If a Black Rainstorm Warning or a Tropical Cyclone Warning Signal No. 3 or above is hoisted at 06:30 am, the program will be cancelled for the day. The remaining program days will commence as normal, weather permitting. If the Black Rainstorm Warning or Tropical Cyclone Warning Signal No. 3 or above is cancelled before 6:30 am, the program will commence as normal. APA will notify participants of cancellations as soon as possible.
If a program day is cancelled due to inclement weather, there will be no refund of program fees but APA will arrange a rescheduled day for participants on the following Saturday. If there is more than one day postponed we will inform the participants of the additional make up day dates.
INDEMNITY
The Participant will hold APA blameless in and from all claims, liabilities, damages, costs and detriments not arising directly from APA’s actual negligence or malpractice in carrying out the agreed program. APA carries public liability insurance for claims arising during program activities only. This insurance coverage does not apply to any transport to and/or from activity locations at the commencement, during or after the program and the Participant agrees that APA shall not be liable for any claims, liabilities, damages, costs or detriments arising from or in connection with the transport to and/or from activity locations.
APA has selected independent transportation carriers, youth hostels, guesthouses and other suppliers of services connected with our programs (“Other Providers”). APA does not own, operate, supervise or manage any person, entity or facility of these Other
Providers and all such persons and entities are independent contractors. As a result, APA is not liable for any negligent or wilful act or failure to act of any such person or entity, or of any other third party.
Parents/legals guardian must sign for any participating minor (those are under 18 years of age) and agree that they and the minor are subject to all the terms of this document as above.
By checking below, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
