In Consideration of permission granted by Camp Kahquah and Bethel PentecostalChurch to use the camp’s property, facilities and amenities, and equipment (the “facilities) in activities sponsored or organized by the camp (“activities”).I,the undersigned,release Bethel Pentecostal Church and Camp Kahquah and its employees, representatives, volunteers, and board members (collectively called “Camp Kahquah”) from all liability and waive all recourse against Camp Kahquah and Bethel Pentecostal Church for loss or damage that I may suffer or that my next of kin (or those in my care) may suffer as a result of my participation in the Activities carried out on and in the vicinity of the Facilities including the waterfront and dock adjacent to the facilities (the “waterfront”).
I acknowledge that I do not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent me from participating in the activity.
I further acknowledge and agree:
1. To follow the rules and regulations established by Bethel Pentecostal Church and Camp Kahquah.
2. That participating in the activity may result in injury and I accept the risk that those activities may present.
3. That in order to participate in kayaking or paddle boarding, I must wear a certified life jacket at all times.
4. That Camp Kahquah is located in a natural setting which presents changes and variability in the terrain and weather as well as other unpredictable elements and, as a result, the Facilities and Activities may present certain risks, hazards and dangers to my person and my property.
5. That no Waterfront supervision is provided by Camp Kahquah or Bethel Pentecostal Church. Guests are expected to follow the guidelines provided for the use of the Waterfront.
6. That no medical or first aid personnel are provided by Camp Kahquah or Bethel Pentecostal Church.
7. That some of the risks, hazards, and dangers mentioned above are foreseeable but others are not.
8. That I freely and voluntarily assume all risks, hazards and dangers and acknowledge that my use of Camp Kahquah's Facilities and Waterfront are entirely at my own risk.
9. To leave the Facilities that I have used in a state similar to their condition upon arrival.
10. That Camp Kahquah does not permit pets of any kind. (If a disability requires the assistance of a service animal, please contact Bethel Pentecostal Church to make appropriate arrangements prior to your arrival).
11. That alcohol, tobacco, vaping, marijuana, and illegal drug use is strictly prohibited on the property of Camp Kahquah. Camp Kahquah and Bethel Pentecostal church has the right to dismiss anyone who does not follow this policy.
12. To conserve the natural beauty and man-made facilities of Camp Kahquah and refrain from disfiguring, defacing, damaging, or destroying the site.
13. That I have carefully read and understand this COMPLETE RELEASE, WAIVER OF CLAIM, AND ASSUMPTION OF RISK.
14. That Bethel Pentecostal Church does not and will not permit me to participate in any activity unless I sign this COMPLETE RELEASE, WAIVER OF CLAIM, AND ASSUMPTION OF RISK and that the terms of this Agreement need not be brought to my attention each time I participate in Activities in order to be effective.
15. That I am 18 years of age or older, and that all minors with me are expected to be under the care of a responsible adult.
16. To release Camp Kahquah and Bethel Pentecostal Church from all liability, claims of action, loss, or damage arising out of my participation in the Activities carried out on and in the vicinity of the Facilities or Waterfront, however caused, and notwithstanding that such injury, damage, or loss to me or my property may have been contributed to or caused by the negligence of Camp Kahquah and Bethel Pentecostal Church.
17. That I consent to medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event.
