    SCROLL DOWN AND SIGN HARMONNY PERFORMING ARTS COMMUNITY LENDING AGREEMENT SECTION 1.    ELIGIBILITY Lending is restricted to community members aged eighteen (18) years or older, with valid photo identification.  Community members under the age of eighteen (18) may borrow an instrument and/or equipment with parent or legal guardian’s permission and signature. SECTION 2.    LOAN PERIOD For students enrolled in a school music program, the loan will be renewed on January 15, June 15, and September 15.   The borrower may borrow one musical instrument at a time unless special permission is granted.  For non-students, the loan will be renewed every six (6) weeks, subject to HarmoNNY staff approval.  HarmoNNY reserves the right to deny renewal to students and non-students. SECTION 3.    COST There will be no cost or payment associated with instrument and/or equipment loans. SECTION 4.    RENEWALS Loan renewals will be considered on a case-by-case basis if there is no waiting list for the particular instrument and/or equipment lent to borrower.  Renewals are subject to inspection by HarmoNNY staff.  If HarmoNNY staff determines the instrument and/or equipment is not being well cared for by the borrower, the renewal shall be denied, and the borrower may be held responsible for the cost of any repairs. SECTION 5.    CARE OF INSTRUMENT/EQUIPMENT Instruments are to be kept in climate-controlled conditions, must be regularly cleaned, and must be handled with care.  Reasonable wear and tear is expected. SECTION 6.    LIABILITY The borrower agrees to assume any and all legal liability for the cost of repair or replacement in the event of loss due to theft, damage, negligence, or misuse.  Parents and/or legal guardians are responsible for materials borrowed by minors in their care. SECTION 7.    RETURN At the end of the loan period, the borrower must return the borrowed instrument and/or equipment to HarmoNNY.  Upon return, the borrowed instrument and/or equipment must be in the same or substantially the same condition as it was at the time of the original lending.  In the event such instrument and/or equipment is not in the same or substantially the same condition as it was at the time of original lending, the borrower shall be responsible for the cost of repairing or replacing the same. SECTION 8.    FAILURE TO RETURN Borrower, and/or the parent or legal guardian of a minor borrower, agrees that in the event borrower fails to return any borrowed instrument and/or equipment at the end of the loan period, borrower and/or the parent or legal guardian of a minor borrower shall be liable to HarmoNNY Performing Arts Community for the cost of replacing the instrument and/or equipment which borrower failed to return.  If necessary, HarmoNNY shall have the right to seek a Judgment from a Court of appropriate jurisdiction against borrower or, as the case may be, against the parent or legal guardian of a minor borrower.  SECTION 9.    GOVERNING LAW This Agreement is governed by and construed according to the laws of the State of New York, where the subject organization is located.  If any of the terms or conditions stated herein conflict with any such law, then such terms or conditions shall be deemed modified and amended to conform to such law. SECTION 10. SEVERABILITY The invalidity of any provision in this Agreement or of its application to any person or circumstances as determined by any government agency or court shall in no way affect the validity of any other provision hereof and all other terms of this Agreement shall be valid and enforceable to the fullest extent permitted by law.
